A CPLR Article 78 Proceeding is designed to challenge governmental action, or inaction. Using this vehicle, a civil servant can challenge adverse employment decisions at the State Supreme Court level. The judge hearing the case will review the facts and law, scrutinize the government's conduct, and if necessary, order the agency to correct its actions and/or conduct.
